You better ask this the main hardware and protocol producer.
e.g. Walkera,Spektrum, FrSky, ..etc

With regard to EN 300 328 Devo and DSM2 are non hopping DSSS Systems.
So the requirements are different than for the FHSS Systems like FrSky, Futaba T-FHSS, FASSTest etc.

Most discussed Limits of EN300328 V1.8.1 for DEVO and DSM2/DSMX:
TX-Power:<= 20dBm (=100mW) E.I.R.P
Power Spectral Density:<= 10mW / 1MHz (Part 4.3.2.2.)

1. Nobody has ever made any compliance tests with deviation, so its usage is your own resposibility.
2. Deviation tries to behave as close as possible to the original OEM protocol, so with regard to compliance it should be similar - at least with devo protocol.
3. Sadly Walkera has not published any compliance tests in accordance to EN300328 which would allow 100mW TX-Power in Europe,
The only test I found in German forum is in regard to EN300440 which allows 10mW.
4. If we want to use devo with 100mW in Europe, this leaves us to guessing by reference to the FCC measurements.
You can search transition.fcc.gov/oet/ea/fccid/ and enter the FCC-ID:
i.e. for Devo10: S29 DEVO-10
There you can find:
Devo-10FCC Test resultLimit for EN 300328 V1.8.1
max TX-Power:19.31 dBm (EIRP) (0.085W)20 dBm (=100mW) E.I.R.P.
Power Spectral Density:6.03 dBm/3KHz10 dBm / 1MHz

Question to the HF-Gurus
FCC Part 15.247:EN300328 V1.8.1:
Power Spectral Density < 8db / 3kHzPower Spectral Density < 10dBm / 1MHz

Which one is more restrictive?
